Agreement to Terms

By accessing and using SumitWeb services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service apply to all visitors, users, and others who access or use the service.

Description of Service

SumitWeb provides web development, UI/UX design, and digital solutions including but not limited to website development, mobile app development, custom software solutions, and consulting services. We work with clients to create digital experiences that meet their specific business needs.

Client Responsibilities

• Provide accurate and complete project requirements
• Supply necessary content, images, and materials in a timely manner
• Provide feedback and approvals within agreed timeframes
• Make timely payments as outlined in project agreements
• Maintain backup of your own data and content
• Test deliverables and provide feedback for revisions

Our Responsibilities

• Deliver professional-quality web development and design services
• Communicate project progress and updates regularly
• Provide revisions as outlined in project scope
• Ensure deliverables meet agreed specifications
• Maintain confidentiality of client information
• Provide technical support as specified in service agreements

Payment Terms

Payment Schedule

• 50% advance payment to initiate project work
• 25% payment upon completion of design phase
• 25% final payment upon project completion and delivery

Payment Methods

We accept bank transfers, UPI, and other agreed payment methods.

Late Payments

Late payments may incur interest at 2% per month and may delay project delivery.

Project Timeline and Delivery

Project timelines are estimates based on current scope and requirements:

• Timelines may be affected by client feedback delays
• Scope changes may impact delivery dates
• We will communicate any timeline changes promptly
• Rush projects may incur additional charges

Intellectual Property Rights

Client Ownership

Upon full payment, clients own the final deliverables and all intellectual property rights.

Our Rights

We retain the right to display completed projects in our portfolio and marketing materials.

Third-Party Assets

Clients are responsible for licensing any third-party assets (images, fonts, plugins) used in projects.

Confidentiality

Both parties agree to maintain confidentiality of all proprietary information shared during the project. This includes business strategies, technical specifications, and any other confidential information.

Refund Policy

Refund Conditions

• No refunds on work already completed
• Refunds only considered if we fail to deliver agreed services
• Client-requested cancellations may incur cancellation fees

Refund Process

Refund requests must be submitted in writing and will be evaluated within 14 business days.

Warranty and Support

We provide the following warranties and support:

• 30-day bug fix warranty for delivered projects
• Technical support for 3 months post-delivery
• Training and documentation as specified in project scope
• Warranty does not cover damage caused by third-party modifications

Limitation of Liability

SumitWeb shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. Our total liability shall not exceed the amount paid for the specific service in question.

Termination

Either party may terminate the agreement under the following conditions:

• Written notice of termination
• Payment for all work completed up to termination date
• Return of all confidential materials
• Client termination may incur cancellation fees based on work completed

Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond their reasonable control, including but not limited to natural disasters, war, terrorism, or government regulations.

Dispute Resolution

Any disputes arising from these terms shall be resolved through good faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of courts in Nagpur, India.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of any modifications.
